Article 3 - Description of Services

3.1. Description of Site Services

MESINEDO provides Users, through its Site, with access to a number of Services aimed at allowing them, in particular, to benefit from editorial content related to fashion and lifestyle.

All Services provided by MESINEDO and made available to the User are detailed on the Site.

Furthermore, it is recalled that the Site also allows Customers to purchase Products under the terms of the General Terms and Conditions of Sale available by clicking here.

3.2. Description of Exclusive Area Services

Certain Products identified on the Site contain an NFC (Near Field Communication) chip allowing access to the Exclusive Area.

To access the Exclusive Area, the User who owns a Product must scan the Product's NFC chip using a smartphone.

The User then accesses the Site's Exclusive Area, where they must enter the Product's order number, first name, last name, and email address in order to identify the purchased Product.

Once registration is complete, the User accesses the Exclusive Area by scanning the NFC chip and then entering their email address, to which a unique access code is automatically sent.

The User enters the unique access code received at their email address into the Exclusive Area.

Only one access to the Exclusive Area per person (same last name, same first name, same email address) will be permitted, even if a person owns multiple Products.

The User guarantees the accuracy, sincerity, and reliability of the information provided, particularly their Personal Data.

The User must, in particular, provide a single valid and functional email address, which will serve as a means of communication between them and MESINEDO.

Consequently, it is the User's responsibility to update their contact details at any time and as soon as possible via their Account accessible on the Site.

Accordingly, MESINEDO cannot be held liable for any lack of diligence by the User during the subscription, modification, and updating of their Personal Data, or for the resulting consequences of erroneous contact details regarding the delivery of Products.

In the event of resale or transfer of the Product to a third party, the User may submit a request to terminate access to the Exclusive Area to MESINEDO under the conditions provided in Article 12 hereof.

The Services of the Exclusive Area allow, in particular:

  • Identifying the purchased Product;
  • Accessing exclusive content (articles, lookbooks, videos);
  • Benefiting from promotional codes.

The Exclusive Area does not contain any sales area for Products.

Article 4 - Account Creation

To proceed with a purchase of Products and retrieve past Orders (within the meaning of the GTC), the User may create an Account on the Site and provide the requested information, particularly their Personal Data.

Upon creating their Account, the User receives a confirmation email.

Only one Account per person (same last name, same first name, same email address) will be permitted.

The User guarantees the accuracy, sincerity, and reliability of the information provided, particularly their Personal Data.

The User provides, in particular, a single valid and functional email address, which will serve as a means of communication between them and MESINEDO.

The User accesses their Account using a username and password that they create themselves when setting up their Account. The User is solely responsible for the use of these identification elements and is required to keep them secret. MESINEDO cannot be held responsible for the loss or theft of these identification elements.

These elements may only be modified at the initiative of the User or MESINEDO in the event that the User forgets their password, upon written request, or in the event of a security risk to the User's Personal Data.

Article 5 - Access and availability of services

However, MESINEDO reserves the right to interrupt access to all or part of the Services for maintenance and/or improvement work. These interruptions to the Services and/or the Site will, to the extent possible by MESINEDO, be notified to the User in advance, in particular by displaying an alert message on the Site.

In case of emergency, MESINEDO nevertheless reserves the right to suspend all or part of the Services and/or the Site, partially or totally, for a reasonable duration to conduct any required technical operation. These interruptions to the Services and/or the Site shall not entitle the User to any compensation, even if such interruptions occur during the Customer's Product purchase process.

In the event of a breach of any of these obligations, without this list being exhaustive, the Internet User is informed that MESINEDO will have the right to refuse or suspend, unilaterally and without prior notice, their access to all or part of the Services and/or the Site and to suspend, where applicable, access to their Account.

Article 7 - Advertising

MESINEDO reserves the right to broadcast advertising or promotional messages on the Site, including within the framework of the Services.

Article 8 - Limitation of Liability

In any event, MESINEDO cannot be held liable:

  • in the event of unavailability of the Services for reasons such as failure of the public electricity network, failure of cable telecommunications networks, loss of connectivity to the Internet network due to public or private operators, including the Internet User, for any reason whatsoever, including strikes, storms, earthquakes, or any other cause having the characteristics of force majeure;

MESINEDO cannot be held liable for any malfunction of any kind relating to the Internet User's computer equipment as well as their Internet access connection, when accessing the Site and more generally the Services.

More specifically, MESINEDO cannot guarantee the Internet User of the Services regarding problems with access speeds to the Site and/or Services and/or buffering speeds of the Internet User's computer that they might encounter.

Article 9 - Force Majeure

The liability of MESINEDO cannot be sought if the performance of any of its obligations is prevented or delayed due to a case of force majeure as defined by the case law of the French Courts and article 1351 of the Civil Code, including natural disasters, fires, malfunction or interruption of the telecommunications network or the electrical network.

Article 10 - Intellectual Property

10.1. Copyright on the Site

MESINEDO is the owner or licensee of the intellectual property rights for both the general structure of the Site and its content (texts, slogans, graphics, images, videos, photos, programs, Products, and other content). Therefore, without prejudice to the provisions of article 10.5, any representation, reproduction, modification, distortion, and/or total or partial exploitation of the Site and/or the Services and/or the Products, by any process whatsoever and on any medium whatsoever, without the express and prior authorization of MESINEDO, is prohibited and constitutes acts of copyright infringement.

  • generally, any extraction, use, storage, reproduction, representation, or conservation, direct or indirect, partial or total, including in buffer or temporary memory, qualitatively or quantitatively substantial of the content of one or more of MESINEDO's databases, committed by any of the processes referred to above, is strictly prohibited, including by media not authorized by MESINEDO.

10.5. Content of the Services

The Internet User acknowledges and accepts that access to the Site and the Services made available to them by MESINEDO does not entail any transfer or concession of intellectual property rights (notably copyrights) and other rights for their benefit, with the exception of those concerning the conditions and modalities of the T&Cs and GCS.

The Internet User acknowledges and accepts that the private and personal use granted to them by MESINEDO, by virtue of access to its Services, excludes in particular access to the Services with a view to collective use of its content, the reproduction, representation, resale, exchange, rental, transfer to a third party, modification, adaptation, correction, whether free of charge or for payment, of all or part of the Site, the Services, and their content.
