Article 3 - Order
The Order is placed exclusively on the Site after completing the following four successive steps:
3.1. Selection of Products
MESINEDO invites the Client to purchase the Product(s) of their choice offered on the Site.
Prior to placing their Order, the Client may directly view the characteristics of the Product(s) they wish to order on the Site.
After clicking the "Add to cart" icon and verifying and, if necessary, modifying the specifics of their Order (Product, quantity, size, color, price, etc.) based on the references of the offers visible on the Site, the Client confirms the selection of the item(s) by clicking on the "Confirm Order" icon. Information on the availability of the item(s) is provided during the Order process for indicative purposes only.
3.2. Identification
If the Client already has a mesinedo.fr Account, they must fill in the fields provided for this purpose to identify themselves on the Site by providing their username (pseudo) and personal password.
Otherwise, the Client may:
- Follow a registration procedure to obtain a mesinedo.fr Account;
- Place their Order as a guest without creating an Account.
The conditions and procedures for creating an account are detailed in the GTCU, available by clicking here.
3.3. Validation
Before confirming their Order, the Client has the possibility to verify the details and total price thereof and to correct any errors before confirming their acceptance. For the Order to be validated, the Client must accept these GTCs by clicking in the indicated location during the payment method selection. They must also choose the delivery address and method, and finally validate the payment method. After accessing a summary and choosing their payment method, the Client will validate their Order by clicking on the "Order" button.
3.4. Payment
After confirming the contents of their Order, the Client will definitively validate it through payment. The Order will only be final upon payment of the corresponding price. Accepted payment methods to date are: Carte Bleue, VISA card, MASTERCARD, Paypal, SHOP.
To ensure the security of online payments, the Site uses the secure payment services of Payplug. These services use the 3-D Secure portal and comply with the DSP2 standard.
Payment is made on the Site through a secure banking platform, which is managed by a third-party company. In this context, MESINEDO does not at any time have access to the Client's payment information and cannot be held liable in the event of fraudulent use of the payment methods used.
When the bank details are validated, the secure payment manager sends an authorization request to the bank card network. The payment manager issues an electronic certificate. The electronic certificate issued by the payment manager shall serve as proof of the amount and date of the transaction, in accordance with the provisions of Articles 1316 et seq. of the Civil Code, as well as the electronic archiving methods implemented by MESINEDO.
In this regard, the server's date and time shall be deemed authentic between the parties.
The Order placed by the Client will only be final upon the effective payment of the Order amount by the Client.
The Client guarantees that they are fully authorized to use the payment card provided for the payment of their Order and that this card provides access to sufficient funds to cover all costs resulting from this Order.
In all cases, payment of the Order constitutes signature and express acceptance of the sale, including its price. MESINEDO will acknowledge receipt of the Order upon validation by email or by any other means at its convenience.
3.5. Order Refusal
MESINEDO reserves the right to suspend any Order processing and delivery in the event of payment authorization refusal by officially accredited organizations or in the event of non-payment. MESINEDO reserves in particular the right to refuse to deliver or to honor an Order from a Client who has not fully or partially paid for a previous Order or with whom a payment dispute is in progress.
Orders placed on the Site can only be for personal purposes, as declared and acknowledged by the Client. In this regard, MESINEDO reserves the right to limit the number of Orders placed if the excessive number suggests a commercial use of said Products.
These restrictions may apply to Orders placed via the same credit card, or using the same billing and/or shipping address.
The Client agrees not to resell the Products, with MESINEDO reserving the right to prohibit sales to any Client who resells Products.
3.6. Order Tracking
For any question regarding the tracking of their Order, the Client can contact MESINEDO at +33 7 56 44 40 80 (cost of a local call, available Monday to Friday, excluding public holidays) or via the form available on this page https://mesinedo.fr/pages/contact.
3.7. Order Confirmation
The Client receives an email confirming their Order within a reasonable time after payment of the Order and at the latest on the day of delivery. These GTCs, as well as the Withdrawal Form in the Appendix, in accordance with Article L. 221-5 of the Consumer Code, are consultable at any time on the Site.
Article 4 - Product description and availability
The Products governed by the GTCs are those appearing on the Site. Product offers are valid as long as they are visible on the Site. The Products are described and presented with the greatest possible accuracy. However, if errors or omissions have occurred in this presentation, MESINEDO cannot be held liable. Photographs of the Products are not contractually binding.
Certains Products identified on the Site contain an NFC (Near Field Communication) chip providing access to exclusive MESINEDO content (articles, lookbooks, videos, promo codes, etc.).
The terms of access and use of this content are detailed in the General Terms and Conditions, available by clicking here.
MESINEDO undertakes to fulfill Orders received on the Site only within the limits of available Product stocks.
In the event of the unavailability of a Product ordered after an Order has been placed, the Customer will be informed as soon as possible by email. If the Order includes several Products, it will be shipped without the out-of-stock Product, which will be fully refunded within 30 days. If the Order contains only one out-of-stock Product, the Order will be canceled and refunded within 30 days.
Article 5 - Price
Prices are indicated in euros, inclusive of all taxes. They take into account the VAT applicable on the day of the Order. Any change in the applicable rate may be passed on to the prices of the Products. Likewise, if one or more taxes or contributions, particularly environmental ones, were to be created or modified, whether increased or decreased, this change may be passed on to the selling price of the Products.
Payment of the full price must be made at the time of the Order. At no time may the sums paid be considered as deposits or installments.
MESINEDO reserves the right to modify its prices at any time but undertakes to apply the rates in force indicated at the time of the Order, subject to availability on that date.
Prices do not include the flat-rate contribution to Order processing costs (postage, packaging, and parcel preparation), which will be charged to the Customer in addition, except in the case of a special exemption offer, and indicated before final validation of the Order.
The Customer remains responsible for telecommunication costs incurred when accessing the Internet and using the Site, as well as when calling the numbers indicated in the General Terms and Conditions of Sale.
Article 6 - Delivery and collection
The terms of Delivery and return are set as follows and also appear on the "FAQ" page of the Site.
6.1. Place of delivery
Articles are sent to the delivery address or collection point indicated by the Customer during the Order process.
The Products are delivered:
- In Metropolitan France
- Overseas: Destinations include Guadeloupe, Martinique, Reunion, French Guiana, Mayotte, Saint Pierre and Miquelon, and French Polynesia;
- Internationally:
- Europe;
- World: Currently only to the United Kingdom.
MESINEDO cannot be held liable in any way for delays and/or non-delivery due to the address provided by the Customer, particularly in the event of a false or incorrect address or where delivery proves impossible.
In the event of a parcel being returned to MESINEDO by the delivery company, Customer Service will contact the Customer for a possible reshipment at the Customer's expense. If there is no response from the Customer within 30 calendar days, MESINEDO will issue a refund, excluding personalized items.
Specific conditions for the delivery provider:
If delivery is requested to an address chosen by the Customer, the parcel is handed over in person or delivered to their mailbox. In the event of absence during delivery, a delivery notice will be left in the mailbox, and the parcel will be made available to the Customer at their local post office. The Customer will have 10 business days from the arrival of the parcel at the post office to come and collect it. After this period, it will be returned to MESINEDO. In all cases, the Customer is informed by email 24 hours before the delivery of their parcel.
In the event of a request for collection at a relay point (for Metropolitan France only), the Customer will be informed of the availability of their parcel by SMS and/or email, with a collection slip allowing them to collect it within 10 business days, upon presentation of a valid identity document. After this period, the parcel will be returned to MESINEDO.
6.2. Delivery time
Shipment of the ordered Product(s) will take place no later than 30 days (indicative period) from the day following the Order, subject to full payment of the price by the Customer for available items, unless otherwise specified to the Customer before placing the Order and prior to its final validation.
In such cases, MESINEDO will provide the Customer with an estimated delivery date range. This period will be indicated as an estimate in the Delivery section of the Site. Delivery times cannot be guaranteed in cases of force majeure, including strikes.
Regarding Products on pre-order or out of stock, the delivery time is calculated from the date of availability of the Products.
After a period of 6 weeks without any delivery, MESINEDO will propose the cancellation of the Order and a refund to the Customer.
Specific conditions for the delivery provider:
The delivery time is calculated from the time the parcel is handed over to La Poste (allow 2 to 6 business days, for Metropolitan France, after placing the Order to receive the parcel).
Generally speaking, the indicative delivery times based on destinations are as follows:
- Metropolitan France: Delivery in 24 to 48 hours (business days).
- Overseas: Destinations include Guadeloupe, Martinique, Reunion, French Guiana, Mayotte, Saint Pierre and Miquelon, and French Polynesia, with indicative times starting from 5 to 7 business days depending on the destination.
- International:
- Europe: starting from 3 business days.
- World: Times vary according to destination, generally between 5 and 10 business days.
6.3. Delivery cost
The Customer's contribution to logistical preparation and shipping costs is inclusive of all taxes. Details of the costs are indicated on the Order summary.
The choice of delivery option entails a different cost.
Please note that for shipments abroad, customs duties (the amount of which depends on the legislation of each country) may be requested from the Customer upon delivery. No refund of customs duties is possible.
Each parcel has online tracking.
6.4. Delivery completed
Each delivery is deemed to have been completed as soon as the article is handed over to the Customer, particularly by the carrier, as evidenced by the control system used.
Upon Order, the Customer will receive an invoice detailing the price of each article(s) and the delivery costs charged to them.
The Customer is expressly informed that it is their responsibility, upon delivery of the parcel, to verify its general condition (damage, damaged parcel, etc.) as well as its contents and to ensure that it conforms to their Order (number, etc.). If this is not the case, the Customer must imperatively assert their remarks or express and written reservations on the delivery note under the conditions specified in Article 9 below.
Article 7 - Right of withdrawal
In accordance with the provisions of Article L. 221-18 et seq. of the Consumer Code, the Customer has a period of 14 business days from the delivery date of their Order to return any article that does not suit them and request an exchange or refund, by sending to MESINEDO the withdrawal form annexed hereto, without having to justify their reasons or pay penalties, with the exception of return costs.
Only Products returned in their entirety, in their complete and intact original packaging, and in perfect condition for resale will be accepted. Any Product that has been damaged, or whose original packaging has been damaged, will neither be refunded nor exchanged.
After communicating their decision to withdraw, the Customer then has a period of 14 days to send or return the goods. The Product must be returned to the seller, complete, unassembled, and in its original packaging, by registered mail to the address mentioned in Article 8. It is specified that in the case of a gift, the right of withdrawal remains the exclusive benefit of the Customer and cannot be exercised by the recipient of the gift.
Personalized products
As an exception to the above, and in accordance with the provisions of Article L 221-28 3° of the Consumer Code, the Customer is informed that the right of withdrawal does not apply to sales of articles personalized at their request, such as, for example, a tennis racket with personalized stringing.
Hygiene products
As an exception to the above, and in accordance with the provisions of Article L 221-28 5° of the Consumer Code, the Customer is informed that the right of withdrawal does not apply to sales of articles that have been unsealed by the consumer after delivery and that cannot be returned for reasons of hygiene or health protection.
Article 8 - Conformity of products
If, at the time of delivery (at home or at a collection point), the original packaging is damaged, torn, or opened, the Customer must then check the condition of the articles. If they have been damaged, the Customer must imperatively refuse the parcel and note a reservation on the delivery slip (parcel refused because it was opened or damaged).
Generally speaking, for home or relay point deliveries, the Customer must indicate on the delivery note, in the form of handwritten reservations accompanied by their signature, any non-conformity of the Products in terms of nature or quality compared to the indications on the Order form (such as damage, Product missing relative to the delivery note, damaged parcel, broken Products, etc.). This verification is considered to have been performed once the Customer, or a person authorized by them, has signed the delivery slip.
The Customer must then confirm these reservations to the carrier by registered letter within two business days following receipt of the article(s) and immediately transmit a copy of this letter to MESINEDO by email (bonjour@mesinedo.fr) or by mail (MESINEDO – Bureau 326, 78 Avenue Des Champs Elysées, 75008 PARIS).
Any complaint not made in accordance with the rules defined above and within the allotted deadlines cannot be taken into account and will release MESINEDO from any liability towards the Customer.
MESINEDO undertakes to exchange, issue a credit note, or refund Products that are defective, damaged, or do not correspond to the Customer's Order.
Article 9 - Return
In the event of withdrawal or non-conformity, Products requiring return to MESINEDO must be returned by the Customer within 15 (fifteen) calendar days from the date of receipt of the Order, and under the following conditions:
- in their original packaging;
- complete (accessories, instructions, tags);
- clean and unworn;
- neither damaged nor deteriorated;
- for Products equipped with one, provided the NFC chip has not been activated;
- accompanied by the corresponding original invoice.
In the event of a return for non-conformity, the Customer must also include in their package the reasons for the alleged non-conformity. Items not returned within the timeframes and under the conditions referred to above will neither be refunded nor exchanged by MESINEDO.
In particular, any item returned damaged, spoiled, incomplete, or soiled will be refused by MESINEDO and will therefore not give rise to an exchange or refund, and which has not been subject to remarks or express written reservations by the Customer upon collection or receipt during delivery by the carrier.
Returns must be made to the following address: MESINEDO – Bureau 326, 78 Avenue Des Champs Elysées, 75008 PARIS.
In the event of exercising the right of withdrawal, return shipping costs are the responsibility of the Customer. For better security, it is recommended to return the package via registered mail with acknowledgment of receipt or by any other means allowing for package tracking.
In the event of non-conformity of the item(s), re-shipping costs incurred by the Customer are covered by MESINEDO. The Customer must contact MESINEDO at +33 7 56 44 40 80 (cost of a local call, available Monday to Friday, excluding public holidays) or via the form available on this page https://mesinedo.fr/pages/contact, so that a return shipping label can be sent to them.
Article 10 - Refund
In the event of withdrawal, duly justified non-conformity, or cancellation of the Order due to unavailability, or any other reason provided for in these T&Cs, MESINEDO undertakes to refund the sums collected within fourteen (14) working days by credit to the Customer's bank account corresponding to the bank card used for payment or by bank transfer.
However, MESINEDO reserves the right to defer the refund in the following cases:
- until receipt of the Product in its entirety;
- until receipt of proof of shipment of the entire Product (mentioning the sender, the recipient, and the shipped Product).
If, at the time of their Order, the Customer benefited from a promotional advantage such as a discount, they will be refunded at the price they actually paid.
In the event of a promotional offer involving multiple Products, MESINEDO reserves the right to require the return of all Products constituting the promotional offer concerned in the event of a refund request. In the event of a new Order, if the new Order is for a higher amount, the Customer must include payment for the balance with the exchange request.
Conversely, if the amount of the exchange is lower than the initial amount, the Customer will receive, upon receipt of the request, a credit in the form of a code for the refund of the difference. This credit must be used within twelve months of its issuance; after this period, the use or refund of this credit cannot be claimed by the Customer for any reason whatsoever.
Article 11 - Responsibilities and guarantees
The consumer has a period of two years from the delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance.
When the sales contract for the goods provides for the supply of digital content or a digital service continuously for a period exceeding two years, the legal guarantee is applicable to this digital content or digital service throughout the entire period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date of its appearance.
The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to maintain the conformity of the goods.
The legal guarantee of conformity entitles the consumer to the repair or replacement of the goods within thirty days of their request, at no cost and without major inconvenience to them.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer requests the repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.
The consumer may obtain a reduction in the purchase price by keeping the goods or terminate the contract by obtaining a full refund in exchange for returning the goods, if:
- The professional refuses to repair or replace the goods;
- The repair or replacement of the goods occurs after a period of thirty days;
- The repair or replacement of the goods causes a major inconvenience to the consumer, in particular when the consumer definitively bears the costs of return or removal of the non-conforming goods, or if they bear the costs of installation of the repaired or replacement goods;
- The non-conformity of the goods persists despite the seller's attempted compliance, which remained unsuccessful.
The consumer is also entitled to a reduction in the price of the goods or the rescission of the contract when the lack of conformity is so serious that it justifies an immediate reduction in price or rescission of the contract. The consumer is not then required to request the repair or replacement of the goods beforehand.
The consumer is not entitled to the rescission of the sale if the lack of conformity is minor.
Any period of immobilization of the goods for repair or replacement suspends the guarantee that was still running until the delivery of the restored goods.
The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code.
A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of a maximum amount of 300,000 euros, which may be increased to 10% of the average annual turnover (article L. 241-5 of the Consumer Code).
The consumer also benefits from the legal guarantee for hidden defects in application of articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or a full refund against the return of the goods.
It is specified that the guarantees do not apply to normal wear and tear of certain parts or items, nor in the event of professional or collective use, nor to damage caused by causes external to the items. The Customer is expressly informed that MESINEDO is not the producer of all the Products presented within the meaning of Law No. 98-389 of May 19, 1998, relating to liability for defective Products.
For all stages of access to the Site, consultation, filling out forms, placing an Order, delivery of items, or any other service, MESINEDO has only an obligation of means.
Consequently, the liability of MESINEDO cannot be engaged for any inconvenience or damage inherent in the use of the internet network and totally external to the diligence and precautions taken by MESINEDO. In particular, any disruption in the provision of the service, or any external intrusion or presence of a computer virus, cannot engage the liability of MESINEDO.
MESINEDO rejects all liability, from the handing over of the Order to the delivery company, for any event affecting the delivery (delay or other anomaly) that would be attributable either to the Customer or to the unforeseeable and insurmountable act of a third party to the contract (notably the delivery company), or to a case of force majeure. Consequently, no claim for compensation of any nature whatsoever may be made by the Customer against MESINEDO.
Article 12 - Personal data and cookies
The Customer's Personal Data is processed in accordance with the MESINEDO Privacy Policy, accessible by clicking here.
Article 13 - Miscellaneous provisions
The T&Cs express the entirety of the parties' obligations. No indication, no document can create obligations under these terms, unless they are the subject of an amendment signed by both parties.
Any tolerance or waiver by one of the parties in the application of all or part of the commitments provided for in these terms, regardless of its frequency or duration, shall not constitute a modification of this agreement, nor generate any right whatsoever. Consequently, no delay or inaction, abstention or omission on the part of MESINEDO in exercising any of its rights shall prejudice said right, nor shall it be considered as implying a waiver on its part to assert that right.
If one or more stipulations of the T&Cs are held to be invalid or declared as such in application of a law, a regulation, or following a final decision of a competent jurisdiction, the other stipulations shall retain their full force and scope.
Failure by the Customer to comply with the obligations subscribed to under the T&Cs, and in particular regarding any payment incident for the price of an Order, incorrect address, or other problem on the Customer's account, may lead to the suspension of access to the sales service on the Site, or even the termination of their MESINEDO account depending on the severity of the actions in question, without prejudice to any damages that MESINEDO may claim.
In accordance with the provisions of Articles L.611-1 and R 612-1 et seq. of the Consumer Code regarding the amicable settlement of disputes: when the consumer has sent a written complaint to the professional and has not obtained satisfaction or a response within a period of two months, they may submit their complaint to the consumer mediator free of charge. The mediator must be contacted within a maximum period of one year from the initial complaint.
The mediator is:
